Construction Malespín sentenced for illegal software

The Justice Department and the Business Software Alliance got a final rulingagainst software piracy in the civil construction company, Constructora Malespín.The ruling of the Criminal Chamber of the Court of Appeal of the Province ofSanto Domingo, last May, and not be appealed, became final.

According to the verdict, Mr. David Parra as administrator of MalespínConstruction and the company will have to pay a fine of 25 minimum wages, a figure which can amount to 500.000 billion pesos, according to the calculation applying the penalty the judge . The Business Software Alliance had denounced the company in 2008 and the Office of the province of Santo Domingo, conducted the inspection in August 2008, being over 20 computers which were 37 programs without licenses.

"This amount for which they were convicted is unprecedented in DR and sends astrong message to both potential offenders and owners and lawyers of thejudgments that are still developing," said Montserrat Duran, Director of LegalAffairs Latin America to the BSA. "This greatly strengthens our actions in DR."

At home, the piracy rate dropped this year to 76%, thanks to joint efforts by the Dominican authorities. The loss of the software industry in the Dominican Republic is estimated at $ 87 million.
